Selamat siang rekan guru semuanya . Nasib tenaga honorer sampai detik ini belum ada kejelasanya dari Pemerintah, pasalnya gaji yang dijanjikan sesuai dengan UMK belum juga terealisasikan masih banyak potret-potret menyedihkan yang sering terlihat dilapangan.
Masih banyak guru dan tenaga honorer yang telah bergelar sarjana atau lulus S1 hanya digaji Rp 100 ribu angka yang sangat jauh dari kata layak dan bahkan sering disebut tidak manusiawi. Namun apa mau dikata…?! ini adalah kenyataan yang telah terjadi dan belum mendapatkan penyelesaian dari Pemerintah.
Honorer sejatinya tak bisa disamakan dengan pegawai kontrak apalagi pada pegawai fungsional pendidikan dan kesehatan misalnya mereka ini GTT dan PTT, kita ketahui bersama PPPK pegawai pemerintah dengan perjanjian kontrak hal ini sangat terbalik kalau kita lihat GTT dan PTT mereka ini sifatnya pekerjaan tetap.
UU No. 5 Tahun 2014. Undang-Undang tentang Aparatur Sipil Negara (ASN) tak jelas terhadap pegawai honorer. Intinya, intinya UU ASN tidak mengatur keberadaan pegawai honorer atau sengaja dihapuskan, seperti diatur Pasal 2 ayat (3) UU No. 43 Tahun 1999 tentang Pokok-Pokok Kepegawaian. berikut berita yang kami Lansir dari Hukum Online…
Secara khusus, pemohon memohon pengujian Pasal 2 huruf a, i, j (asas manajemen ASN), Pasal 6 (jenis pegawai ASN), Pasal 58 (proses pengadaan PNS), Pasal 67 (Delegasi PP tata cara pengadaan dan tata cara sumpah PNS) dan Pasal 129 ayat (2) UU ASN (penyelesaian sengketa PNS). Misalnya, Pasal 6 menyebutkan Pegawai ASN terdiri atas a. PNS; dan b. PPPK (Pegawai Pemerintah dengan Perjanjian Kerja).
“Pasal-pasal itu membuat nasib pegawai honorer tidak jelas karena tidak ada pengaturan khusus bagi pegawai honorer atau pegawai tidak tetap (PTT),” ujar Rohmadi dalam sidang pemeriksaan pendahuluan di ruang sidang Mahkamah Konstitusi.
Rochmadi didampingi Anggota FPHI lainnya, Marsono (Pegawai PTT SMAN Sampung Ponorogo) dan Arif Kusuma (Pegawai Guru Honorer SD Besuki Ponorogo).
Rochmadi mengatakan berlakunya UU ASN telah membatalkan UU Pokok-Pokok Kepegawaian yang membagi jenis pegawai negeri menjadi tiga golongan PNS, TNI/Polri, dan tenaga honorer. Perubahan istilah pegawai honorer menjadi PPPK ini bertentangan UU No. 13 Tahun 2003 tentang Ketenagakerjaan. Sebab, UU Ketenagakerjaan menyebutkan pekerjaan yang sifatnya tetap tidak bisa dikontrakkan.
“PPPK sifatnya kontrak, setiap tahun bisa diperpanjang. Padahal, profesi guru, tenaga kesehatan, PTT, sifat pekerjaannya tetap,” ujar Rochmadi di hadapan majelis panel yang diketuai Wahidudin Adams.
Dia melihat melihat UU ASN banyak pertentangan aturan hukum termasuk dengan PP No. 11 Tahun 2002 tentang Pengadaan PNS dan PP No. 56 Tahun 2012 tentang Perubahan Kedua atas PP No. 48 Tahun 2005 tentang Pengangkatan Tenaga Honorer Menjadi CPNS. Menurut dia berlakunya UU ASN menutup ruang tenaga honorer untuk bisa diangkat menjadi CPNS. Sebab, kata “pengadaan” dalam Pasal 58 UU ASN menyiratkan hanya untuk pelamar umum, tanpa hak khusus yang dimiliki tenaga honorer.
“UU ASN “mimpi buruk” bagi pegawai honorer nonkategori. Alih-alih mewadahi tenaga honorer, justru memunculkan PPPK, sebelum nasib tenaga honorer dipastikan. Aturan itu mematikan hak tenaga honorer seperti diamanatkan PP No. 56 Tahun 2012.”
“UU ASN mencerminkan ketidakpastian hukum yang adil dan diskriminatif yang bertentangan dengan Pasal 27 ayat (1), Pasal 28D ayat (1), (3), dan Pasal 28I ayat (2) UUD 1945,” katanya.
Menanggapi permohonan, Wahiddudin Adams mempertanyakan legal standing pemohon apakah atas nama perorangan atau lembaga FPHI?. “Kalau mewakili forum itu, apa status forum itu berbadan hukum perkumpulan, yayasan, ormas? Ini harus diperjelas,” kata Wahid.
Dia juga menilai agar posisi permohonan belum tergambar pertentangan normanya. Uraian permohonan lebih banyak menguraikan pertentangan dengan UU ASN dengan peraturan pemerintah. “Permohonan lebih banyak ‘curhatnya’ ya dan mengkaitkan dengan peraturan pemerintah,” kritiknya.
Dia mengingatkan UU ASN sebagai reformasi birokrasi sebagai pengganti UU Pokok-Pokok Kepegawaian, sehingga hanya mengenal PNS dan PPPK. Hal itu tidak bisa disamakan dengan aturan dalam UU Ketenagakerjaan. “Peraturan pemerintah yang masih mengacu UU Kepegawaian belum bisa diganti karena berlakunya UU ASN masih diberi tenggang waktu 2 tahun sejak diterbitkan,” katanya.
Anggota Majelis, Aswanto meminta pemohon menguraikan kerugian konstitusional dengan diberlakukannya pasal-pasal baik faktual maupun potensial. ”Ini harus betul-betul konkrit diurai dalam permohonan, kalau tidak berakibat permohonan kabur,” kata Aswanto.
Dia menyarankan agar permohonan ini mengatasnamakan perorangan saja karena FPHI belum memiliki AD/ART. “Bagian petitum yang banyak itu diubah dengan format petitum yang berlaku, pemohon bisa melihat contoh-contoh permohoan yang lazim di MK,” pintanya. (Sumber : kkgjaro.blogspot.com).
